As Vietnam intensifies its nationwide crackdown on counterfeit goods, knockoffs, and trade fraud, the Vietnam Global E-Commerce Association (VGEA) is calling on businesses to strictly comply with legal regulations to ensure transparent, lawful operations.
Faced with a surge in violations affecting consumer trust and fair competition, the Vietnamese government has launched a coordinated campaign involving inspections, enforcement actions, and stricter controls across key sectors. To support ethical businesses and protect legitimate trade, VGEA has released detailed compliance guidelines for organizations and individuals bringing products to market.
Key Legal Requirements for Businesses:
- Product Registration and Disclosure
- Mandatory Declarations: Conformity announcements and certifications (per Decision 01/2018/QĐ-TTg) are required for categories such as food, cosmetics, electronics, and children’s toys.
- Special Licensing: Mandatory circulation permits for pharmaceuticals, medical devices, chemicals, and other regulated products.
- Proper Labeling Practices
- In line with Decree 43/2017/NĐ-CP, all goods must display key information in Vietnamese, including product name, ingredients, origin, shelf life, and usage instructions.
- Quality and Safety Standards
- Products must meet the applicable Vietnamese Standards (TCVN) or Technical Regulations (QCVN).
- Items in regulated categories must undergo safety testing at authorized agencies.
- Barcodes and Product Origin
- Businesses distributing through retail channels must register GS1 barcodes.
- Origin (domestic or imported) must be clearly disclosed.
- Sector-Specific Requirements
- Food & Beverages: Must have a food safety certification and meet production standards.
- Imports: Customs clearance and full tax compliance are mandatory.
Important Reminder:
Non-compliance may lead to heavy administrative fines, product seizures, or even criminal charges. VGEA advises companies to consult relevant authorities—such as the Ministry of Industry and Trade, Ministry of Health, and Ministry of Science and Technology—or seek legal counsel to ensure full regulatory alignment.
